    16.1. The balance loaded onto your card is classified as electronic money. This means that the electronic money issuer, GVS Prepaid Limited, holds the funds associated with your card.

    16.2. GVS Prepaid Limited (whose registered office is Westside, London Road, Hemel Hempstead, Hertfordshire, HP3 9TD (company registration number: 09193070)) is authorised and regulated Financial Conduct Authority as an Electronic Money Institution (Registration Number 900230); under the E-Money Regulations 2011.

    16.3. Hawk Incentives Limited (whose registered office is at Westside, London Road, Hemel Hempstead, Hertfordshire, HP3 9TD (company registration number: 4155659)) is the entity that has requested that a card is issued to you, on behalf of the party who provided you with this card and is responsible for providing all the services associated with your card, including but not limited to providing customer service and managing any disputed transactions on your behalf.

    16.4. The party that provided you with your card is the e-money holder. This money is backed by money kept by us in a separate safeguarded bank account.

    16.5. You, the cardholder, are given the right to use the card within the expiry period only.

    16.6. In the event of us becoming insolvent, the balance on your card will be paid out to the e-money holder by the insolvency practitioner from our safeguarded bank account once any applicable costs of insolvency proceedings are settled. This means that the total of funds available to our e-money holders and, may be decreased by the amount of insolvency costs related to the distribution of the funds.

    16.7. E-money issuers are not covered by the Financial Services Compensation Scheme.

    18. GENERAL PROVISIONS

Your rights will not be affected, and you have the right to cancel this agreement (see under Changes to the Terms and Conditions).

    18.2. Each of the Terms included in this document are separate from all other Terms, so if one Term is found to be void or otherwise unenforceable it will not affect the validity of any of the others.

    18.3. If we do not enforce any of the rights we have under this agreement, or if we delay in enforcing them, that does not prevent us from taking any action to enforce our rights in the future.

    18.4. Upon termination of this agreement, the Terms and Conditions that can continue to apply will do so.

    18.5. A person who is not a party to this agreement may not enforce any of its terms under the Contracts (Rights of Third Parties) Act 1999.

    18.6. The laws of England and Wales govern these Terms and Conditions. The courts of England and Wales will have exclusive jurisdiction to deal with any dispute arising in connection with these Terms and Conditions, subject to a referral to the Financial Ombudsman Service (see Complaints Procedure).

    3. New World Elite benefit “Status Lift”: Starting January 1, 2022, WestJet RBC World Elite Mastercard primary cardholders will have access to a new annual benefit to help you get closer to Silver, Gold or Platinum status each year, “Status Lift”. With Status Lift, you can earn $500 in tier qualifying spend, which applies towards achieving the next WestJet Rewards tier, for every $15,000 CAD in Eligible Purchases on your WestJet RBC World Elite Mastercard (up to a maximum of $1,500 in tier qualifying spend in a qualifying year). WestJet’s qualifying year is January 1 to December 31 of each calendar year. “Eligible Purchases” means net purchase transactions (including transactions on additional cards) that appear on your WestJet RBC World Elite Mastercard monthly statements prepared between January 1 and December 31 of each year, explained in further detail below. It is not based on the actual purchase or transaction date.  

    For example, Teal members earning the maximum of $1,500 in tier qualifying spend on Eligible Purchases with Status Lift would be halfway to achieving the $3,000 in tier qualifying spend to achieve Silver status.     Status Lift will automatically take effect beginning with your September 2021 monthly statement. For new WestJet RBC World Elite Mastercard cardholders who activate their card after September 1, 2021, the qualifying benefit period will begin with the first monthly statement following the first purchase transaction on the credit card account.  

    Eligible Purchases for Status Lift are purchases for goods and services minus returns and other credits; credits for returns and adjustments will reduce or cancel Status Lift earned. Eligible purchases do not include fees, interest charges, or cash advances (including balance transfers, cash-like transactions and certain bill payments).  

    Tier qualifying spend derived from Status Lift is earned through Eligible Purchases on the WestJet World Elite Mastercard and will be included in the calculation for determining the tier and resulting status of the primary cardholder only, subject to these benefit conditions. 

    To determine your spend for Status Lift, WestJet will divide the WestJet dollars reported on your WestJet RBC World Elite monthly statement by the standard WestJet dollar earn rate of 1.5%. Any bonus or additional WestJet dollars you may earn will not count towards Status Lift. The date on which your monthly statement is prepared and the WestJet dollars earned as determined by Royal Bank of Canada and reported on your statement will determine the qualifying year that the Eligible Purchases and any resulting Status Lift will be applied to, regardless of when the WestJet dollars are deposited to your WestJet Rewards account. For example, if your monthly statement is prepared on December 27, your Eligible Purchases will count towards Status Lift for the current qualifying year, even if the WestJet dollars are deposited to your account in the following year. 

    Status Lifts are awarded based on your credit card monthly statement date (that is, the date your statement is prepared), not the purchase or transaction date for individual purchase transactions. For greater clarity, Eligible Purchases made prior to the end of the qualifying year will not be eligible for Status Lift for that qualifying year if they do not appear on a monthly statement prepared prior to December 31. For example, if your credit card statement is prepared on the 27th day of each month and you make a purchase on December 28, the transaction will be included on your January statement and will not be an Eligible Purchase for the current qualifying year.  

    Status Lift of $500 CAD will be awarded up to three times during the qualifying year when your Eligible Purchases total 1) $15,000, 2) $30,000 and 3) $45,000 (or, in the case of the Limited-Time Introductory Offer, 1) $5,000, 2) $10,000 and 3) $15,000). Each Status Lift will be awarded approximately 10 business days after the credit card statement date in which the spend threshold is achieved. 

    To receive Status Lift, your credit card account must be open and in good standing at the time of the benefit award. If you cancel your WestJet RBC World Elite Mastercard credit card before the end of a qualifying year, WestJet reserves the right to remove any Status Lift or tier adjustments you may have received through this benefit. 

    Status Lift amounts earned through this benefit are not counted towards the awarding of Milestone awards within the WestJet Rewards program. 

    The Status Lift amount and tier qualifying spend earned on WestJet flight or vacation packages will be combined to calculate total tier qualifying spend which counts towards the achievement of your immediate next tier. Your tier qualifying spend will reset at the start of each qualifying year (January 1st).   

    The end of the qualifying year is December 31, without regard to the time of the year that the WestJet RBC World Elite Mastercard credit card account is opened. This means that in the cardholder’s first year, the eligibility period for the Status Lift benefit may be less than twelve months. 

    This benefit has no monetary or other exchange value and cannot be sold or transferred. 

    WestJet and RBC reserve the right to change or withdraw the benefit at any time. 

    4. WestJet dollars can be used towards payment of the base fare of an eligible flight or vacation package, available on westjet.com or through WestJet’s contact centre. WestJet dollars cannot be applied against taxes, fees or charges and can only be used for new bookings. Minimum redemption rules on flights apply when purchasing Economy, Premium or Business fares. A minimum redemption amount of 50 WestJet dollars per booking applies for WestJet Vacations package bookings. Other restrictions may apply and are subject to change at any time.

    1. DEFINITIONS

    When used in this Agreement with the initial letters capitalized, in addition to the terms defined elsewhere in this Agreement, the following terms have the following meanings:

    Account: means any accounts or instances created by or on behalf of Subscriber or its Agents in regard to the Services.

    Affiliate: means, with respect to a Party, any entity that directly or indirectly controls, is controlled by, or is under common control with such Party.

    Agent: means an individual authorized to use the Service(s) through Your Account as an agent and/or administrator as identified through a unique Login.

    Agreement: means the Master Subscription Agreement with any and all Supplemental Terms, Quotation Order Forms, and other documents such as a SOW (each, where applicable) along with the Life Fitness Privacy Policy and Life Fitness Terms of Use located on Our Site.

    API: means the application programming interfaces developed and enabled by Life Fitness that permit Subscribers to access certain functionality provided by the Services.

    Applicable Data Protection Law: means all laws concerning data protection and data privacy that are applicable to the Parties, including but not limited to the EU General Data Protection Regulation 2016/679 (“GDPR”), , California Consumer Privacy Act of 2018 (codified at Cal. Civ. Code Section 1798.100, et seq.) (CCPA) and its implementing regulations, as amended from time-to-time.

    Associated Services: means products, services, features and functionality designed to be used in conjunction with the Services but not included in the Service Plan to which You subscribe, including, without limitation, integrations and applications created or developed by Life Fitness or its Affiliates, including HaloFitness, and made available in the marketplace (available at https://www.halo.fitness), which will be governed by this Agreement unless Life Fitness otherwise communicates a different agreement to You at the time of Your deployment of or access to the integration or application. For avoidance of doubt, none of the Services or any other product, service, feature or functionality that is expressly stated to be governed by any alternative license, agreement or terms shall be deemed an Associated Service.

    Beta Services: means a product, service or functionality provided by Life Fitness that may be made available to You to try at Your option at no additional charge which is clearly designated as beta, pilot, limited release, non-production, early access, evaluation or by a similar description.

    Confidential Information: means all information disclosed by You to Life Fitness or by Life Fitness to You which is in tangible form and labeled “confidential” (or with a similar legend) or which a reasonable person would understand to be confidential given the nature of the information and circumstances of disclosure, including, but not limited to, information relating to Life Fitness’s security policies and procedures. For purposes of this Agreement, this Agreement as well as Service Data shall be deemed Confidential Information. Notwithstanding the foregoing, Confidential Information shall not include information that (a) was already known to the receiving Party at the time of disclosure by the disclosing Party; (b) was or is obtained by the receiving Party by a third party not known by the receiving Party to be under an obligation of confidentiality with respect to such information; (c) is or becomes generally available to the public other than by violation of this Agreement or another valid agreement between the Parties; or (d) was or is independently developed by the receiving Party without use of the disclosing Party’s Confidential Information.

    3. New World Elite benefit “Status Lift”: Starting January 1, 2022, WestJet RBC World Elite Mastercard primary cardholders will have access to a new annual benefit to help you get closer to Silver, Gold or Platinum status each year, “Status Lift”. With Status Lift, you can earn $500 in tier qualifying spend, which applies towards achieving the next WestJet Rewards tier, for every $15,000 CAD in Eligible Purchases on your WestJet RBC World Elite Mastercard (up to a maximum of $1,500 in tier qualifying spend in a qualifying year). WestJet’s qualifying year is January 1 to December 31 of each calendar year. “Eligible Purchases” means net purchase transactions (including transactions on additional cards) that appear on your WestJet RBC World Elite Mastercard monthly statements prepared between January 1 and December 31 of each year, explained in further detail below. It is not based on the actual purchase or transaction date.

    Status Lift will automatically take effect beginning with your September 2021 monthly statement. For new WestJet RBC World Elite Mastercard cardholders who activate their card after September 1, 2021, the qualifying benefit period will begin with the first monthly statement following the first purchase transaction on the credit card account.  

    Eligible Purchases for Status Lift are purchases for goods and services minus returns and other credits; credits for returns and adjustments will reduce or cancel Status Lift earned. Eligible purchases do not include fees, interest charges, or cash advances (including balance transfers, cash-like transactions and certain bill payments).  

    Tier qualifying spend derived from Status Lift is earned through Eligible Purchases on the WestJet World Elite Mastercard and will be included in the calculation for determining the tier and resulting status of the primary cardholder only, subject to these benefit conditions. 

    To determine your spend for Status Lift, WestJet will divide the WestJet dollars reported on your WestJet RBC World Elite monthly statement by the standard WestJet dollar earn rate of 1.5%. Any bonus or additional WestJet dollars you may earn will not count towards Status Lift. The date on which your monthly statement is prepared and the WestJet dollars earned as determined by Royal Bank of Canada and reported on your statement will determine the qualifying year that the Eligible Purchases and any resulting Status Lift will be applied to, regardless of when the WestJet dollars are deposited to your WestJet Rewards account. For example, if your monthly statement is prepared on December 27, your Eligible Purchases will count towards Status Lift for the current qualifying year, even if the WestJet dollars are deposited to your account in the following year. 

    Status Lifts are awarded based on your credit card monthly statement date (that is, the date your statement is prepared), not the purchase or transaction date for individual purchase transactions. For greater clarity, Eligible Purchases made prior to the end of the qualifying year will not be eligible for Status Lift for that qualifying year if they do not appear on a monthly statement prepared prior to December 31. For example, if your credit card statement is prepared on the 27th day of each month and you make a purchase on December 28, the transaction will be included on your January statement and will not be an Eligible Purchase for the current qualifying year.  

    Status Lift of $500 CAD will be awarded up to three times during the qualifying year when your Eligible Purchases total 1) $15,000, 2) $30,000 and 3) $45,000 (or, in the case of the Limited-Time Introductory Offer, 1) $5,000, 2) $10,000 and 3) $15,000). Each Status Lift will be awarded approximately 10 business days after the credit card statement date in which the spend threshold is achieved. 

    To receive Status Lift, your credit card account must be open and in good standing at the time of the benefit award. If you cancel your WestJet RBC World Elite Mastercard credit card before the end of a qualifying year, WestJet reserves the right to remove any Status Lift or tier adjustments you may have received through this benefit. 

    Status Lift amounts earned through this benefit are not counted towards the awarding of Milestone awards within the WestJet Rewards program. 

    The Status Lift amount and tier qualifying spend earned on WestJet flight or vacation packages will be combined to calculate total tier qualifying spend which counts towards the achievement of your immediate next tier. Your tier qualifying spend will reset at the start of each qualifying year (January 1st).   

    The end of the qualifying year is December 31, without regard to the time of the year that the WestJet RBC World Elite Mastercard credit card account is opened. This means that in the cardholder’s first year, the eligibility period for the Status Lift benefit may be less than twelve months. 

    This benefit has no monetary or other exchange value and cannot be sold or transferred. 

    WestJet and RBC reserve the right to change or withdraw the benefit at any time. 

    4. WestJet dollars can be used towards payment of the base fare of an eligible flight or vacation package, available on westjet.com or through WestJet’s contact centre.     When used in this Agreement with the initial letters capitalized, in addition to the terms defined elsewhere in this Agreement, the following terms have the following meanings:

    Account: means any accounts or instances created by or on behalf of Subscriber or its Agents in regard to the Services.

    Affiliate: means, with respect to a Party, any entity that directly or indirectly controls, is controlled by, or is under common control with such Party.

    Agent: means an individual authorized to use the Service(s) through Your Account as an agent and/or administrator as identified through a unique Login.

    Agreement: means the Master Subscription Agreement with any and all Supplemental Terms, Quotation Order Forms, and other documents such as a SOW (each, where applicable) along with the Life Fitness Privacy Policy and Life Fitness Terms of Use located on Our Site.

    API: means the application programming interfaces developed and enabled by Life Fitness that permit Subscribers to access certain functionality provided by the Services.

    Applicable Data Protection Law: means all laws concerning data protection and data privacy that are applicable to the Parties, including but not limited to the EU General Data Protection Regulation 2016/679 (“GDPR”), , California Consumer Privacy Act of 2018 (codified at Cal. Civ. Code Section 1798.100, et seq.) (CCPA) and its implementing regulations, as amended from time-to-time.

    Associated Services: means products, services, features and functionality designed to be used in conjunction with the Services but not included in the Service Plan to which You subscribe, including, without limitation, integrations and applications created or developed by Life Fitness or its Affiliates, including HaloFitness, and made available in the marketplace (available at https://www.halo.fitness), which will be governed by this Agreement unless Life Fitness otherwise communicates a different agreement to You at the time of Your deployment of or access to the integration or application. For avoidance of doubt, none of the Services or any other product, service, feature or functionality that is expressly stated to be governed by any alternative license, agreement or terms shall be deemed an Associated Service.

    Beta Services: means a product, service or functionality provided by Life Fitness that may be made available to You to try at Your option at no additional charge which is clearly designated as beta, pilot, limited release, non-production, early access, evaluation or by a similar description.

    Confidential Information: means all information disclosed by You to Life Fitness or by Life Fitness to You which is in tangible form and labeled “confidential” (or with a similar legend) or which a reasonable person would understand to be confidential given the nature of the information and circumstances of disclosure, including, but not limited to, information relating to Life Fitness’s security policies and procedures. For purposes of this Agreement, this Agreement as well as Service Data shall be deemed Confidential Information. Notwithstanding the foregoing, Confidential Information shall not include information that (a) was already known to the receiving Party at the time of disclosure by the disclosing Party; (b) was or is obtained by the receiving Party by a third party not known by the receiving Party to be under an obligation of confidentiality with respect to such information; (c) is or becomes generally available to the public other than by violation of this Agreement or another valid agreement between the Parties; or (d) was or is independently developed by the receiving Party without use of the disclosing Party’s Confidential Information.

      1. DEFINITIONS

      When used in this Agreement with the initial letters capitalized, in addition to the terms defined elsewhere in this Agreement, the following terms have the following meanings:

      Account: means any accounts or instances created by or on behalf of Subscriber or its Agents in regard to the Services.

      Affiliate: means, with respect to a Party, any entity that directly or indirectly controls, is controlled by, or is under common control with such Party.

      Agent: means an individual authorized to use the Service(s) through Your Account as an agent and/or administrator as identified through a unique Login.

      Agreement: means the Master Subscription Agreement with any and all Supplemental Terms, Quotation Order Forms, and other documents such as a SOW (each, where applicable) along with the Life Fitness Privacy Policy and Life Fitness Terms of Use located on Our Site.

      API: means the application programming interfaces developed and enabled by Life Fitness that permit Subscribers to access certain functionality provided by the Services.

      Applicable Data Protection Law: means all laws concerning data protection and data privacy that are applicable to the Parties, including but not limited to the EU General Data Protection Master reservation date - Free Activators 2016/679 (“GDPR”),California Consumer Privacy Act of 2018 (codified at Cal. For avoidance of doubt, none of the Services or any other product, service, feature or functionality that is expressly stated to be governed by any alternative license, agreement or terms shall be deemed an Associated Service.

      Beta Services: means a product, service or functionality provided by Life Fitness that may be made available to You to try at Your option at no additional charge which is clearly designated as beta, pilot, limited release, non-production, early access, evaluation or by a similar description.

      Confidential Information: means all information disclosed by You to Life Fitness or by Life Fitness to You which is in tangible form and labeled “confidential” (or with a similar legend) or which a reasonable person would understand to be confidential given the nature of the information and circumstances of disclosure, including, but not limited to, information relating to Life Fitness’s security policies and procedures. For master reservation date - Free Activators of this Agreement, this Agreement as well as Service Master reservation date - Free Activators shall be deemed Confidential Information. Notwithstanding the foregoing, Confidential Information shall not include information that (a) was already known to the receiving Party at the time of disclosure by the disclosing Party; (b) was or is obtained by the receiving Party by a third party not known by the receiving Party to be under an obligation of confidentiality with respect to such information; (c) is or becomes generally available to the public other than by violation of this Agreement or another valid agreement between the Parties; or (d) was or is independently developed by the receiving Party without use of the disclosing Party’s Confidential Information.
